Terms of service for VoiceApp.

VoiceApp is a communication app based in Germany. The app is free of charge. By using VoiceApp, the user confirms that they have read and understood these Terms of Use and agrees to them explicitly.
VoiceApp is provided to the user free of charge. To use all features, registration as a user with a user account and a phone number, as well as an internet connection, are required.
The offer of VoiceApp is partly available through app stores and associated infrastructure, such as the Apple App Store and Google Play Store. The user uses these app stores independently of VoiceApp, and the respective terms and conditions of those app stores apply.
For some features of VoiceApp, access to the address book, photo album, and other data on the user's smartphone is necessary, which VoiceApp can only access with the explicit consent of the user. This access allows the user to, for example, select a profile picture for their user profile or share a file with contacts from the address book. Depending on the operating system used, the user may have to explicitly confirm this access or can explicitly block it for VoiceApp.
VoiceApp strives to maintain high availability and reliability. However, it cannot guarantee that individual functions will be permanently, always, and/or fully available. VoiceApp recommends that users regularly back up their smartphone data.
There is no entitlement to use VoiceApp. The user can be excluded from using VoiceApp.
VoiceApp offers optional, automatically renewing subscriptions (auto-renewable subscriptions) via the Apple App Store and Google Play Store. Payment will be charged to the user’s App Store account upon confirmation of purchase.
The subscription automatically renews unless canceled at least 24 hours before the end of the current period. Cancellations and management options can be handled in the user’s App Store account settings.
Refunds are handled exclusively by the respective App Store. During the active subscription period, users have access to the premium features described in the app (e.g., ad-free experience, supporter badge, rotation effects, and recognition).
By completing a subscription purchase, the user explicitly agrees to these terms.
VooMe is a social audio feature built directly into VoiceApp. Users can record short audio posts, add a title and cover image, and publish them publicly to a global feed or share them privately in chats and group conversations. Public VooMes are visible to all app users as well as visitors of the VoiceApp website.
Rights and Responsibility
By uploading or importing content to VooMe — whether by recording directly in the app or by importing from third-party platforms such as TikTok, YouTube Shorts, or Instagram Reels — the user confirms that they hold all necessary copyrights, licenses, or permissions for that content. Importing content from third-party platforms is the sole responsibility of the user. VoiceApp does not verify the rights of uploaded content and accepts no liability for copyright infringements or other legal violations arising from user-generated content.
Prohibited Content
Users may not publish VooMes that violate applicable law, infringe third-party rights, or contain hateful, discriminatory, harassing, or otherwise inappropriate content. VoiceApp reserves the right to remove such VooMes without notice and to suspend or delete the responsible account.
Reporting
Users can report VooMes that violate these Terms of Use or applicable law using the built-in report function within the app. Reported VooMes will be reviewed by VoiceApp.
VoiceApp, subject to mandatory legal provisions, does not assume any liability for direct or indirect damages arising from the use of VoiceApp.
In the event of violations of these Terms of Use or legal infringements and corresponding claims by third parties, the user expressly indemnifies VoiceApp from any liability and will be fully liable for damages.
VoiceApp may change these Terms of Use at any time. The user will be informed of such changes in an appropriate manner. The user may stop using VoiceApp at any time and delete their account via the app (Profile -> Settings -> Delete account). By continuing to use VoiceApp after being informed of changes to these Terms of Use, the user explicitly agrees to such changes.
The use of VoiceApp, subject to mandatory legal provisions, is governed exclusively by German law and Germany as the exclusive place of jurisdiction.
